ZKS Attorneys, Joanne Prescott and Lindsay Richmond, successfully represented their client before a Judge of Compensation Claims in the Division of Administrative Hearings against a claim for compensability of workers’ compensation benefits.
The claimant filed a Petition for Benefits requesting a significant increase in past and future benefits on the basis that her wages should include accrued vacation and sick leave, and retroactive application of a raise. The defense team conducted thorough legal research and analysis, and argued that the claimant’s Petition for increased benefits was not valid under current law. The Judge agreed and ruled in our client’s favor, resulting in the successful avoidance of paying increased past and future benefits, penalties and interest, and attorney’s fees.
This case was a complex matter, and an adverse ruling would have changed current legal precedent, resulting in huge repercussions across the State of Florida.
